§ 34-496. Variances
(a) Where the planning commission finds that extraordinary hardship may result from strict compliance with these regulations due to unusual topographic or other conditions beyond the control of the subdivider, it may vary the regulations so that substantial justice may be done and the public interest secured; provided, however, that such variation will not have the effect of nullifying the intent or purpose of the this chapter, the thoroughfare plan or other elements of the comprehensive plan. Any variance thus authorized is required to be entered in writing in the minutes of the planning commission and the reason which justified the departure to be set forth.
(b) Plans for all such developments shall be submitted to be approved by the planning commission, whether or not such plat is to be recorded. No building permit shall be issued until such approval has been given.
