§ 34-474. Permanent commercial and industrial structures
(a) No person, firm or corporation shall erect, locate or construct a permanent commercial or industrial structure in the county without first obtaining a building permit for said structure from the planning commission. Applications shall be submitted on forms provided by the planning commission and accompanied by a fee as established by the county schedule of fees.
(b) Permanent commercial and industrial structures must meet the following requirements:
(1) The regulations of the county and health department regarding sanitary facilities, water supply, electrical systems and sewage disposal shall be met.
(2) Commercial and industrial building setback lines shall be at least 60 feet from the center line of a county road and 35 feet from the front property line of a state or federal highway. Side yard and rear yard setbacks are 15 feet from the side and rear property line (see section 34-263).
(3) Conformity with all applicable site development standards as required in article V, division 3, of this chapter.
(c) If an application is denied, then the applicant, within 15 days of such decision, may file an appeal, which request must be in writing, with the planning commission, who, after affording the applicant notice and a public hearing, shall either grant the application or deny it, and such decision shall be final.
