§ 34-203. Zoning change requests

  • (a) Any land owner or such owner's agent requesting a zoning change shall file a written application containing no less than the following items of information:

    (1) Name and address of the petitioner;

    (2) Description of the property in such a manner to identify the same to a lay person;

    (3) Current zoning;

    (4) Names and addresses of the owners and, if applicable, lessees of the property, if different than the petitioner;

    (5) Names and addresses of the owners and, if applicable, lessees of the surrounding property;

    (6) Requested zoning classification and reason for the change, with specificity;

    (7) Such other or additional information as may be requested by the planning director;

    (8) Swearing of the application to be true and correct, and the application shall be signed by the land owner requesting the zoning change; and

    (9) A check for the application fee as listed in the county schedule of fees which will accompany the application for rezoning.

    (b)

    (1)

    Upon presentation of an application for a zoning change to the county, the application shall be forwarded to the planning director, who will examine the property and make a recommendation to the planning commission for action on the application.

    (2) All applicants requesting a zoning change shall notify each owner and, if applicable, each lessee of the abutting property and each lessee with an interest in the property for which the change in zoning is sought by mailing to each such person a copy of the application for zoning change by registered mail, return receipt requested.

    (3) The planning commission may recommend favorably on a rezoning request, conditioned upon the applicant complying with specified conditions the planning commission deems reasonable and appropriate to carry out the purposes of this article and which are designed to harmonize the applicant's request with the public interest. In the event the request is approved upon compliance with certain conditions, the applicant will have so much time as may be granted to the applicant by the planning commission to comply with said conditions and if the applicant fails to comply with said conditions the rezoning request will be deemed denied. No building permit or other permit shall be issued until such time as the zoning administrator determines that the applicant has complied with the specified conditions.

    (4) The planning commission shall review all requests for rezoning property and shall make a recommendation to the county commissioner.
