§ 34-493. Required improvements

  • The subdivider is required to install or construct the following improvements prior to having released the bond or other securities which guarantee installation of such required improvements. All improvements required shall be constructed in accordance with the standards set forth in these regulations, and under the inspection of the county road superintendent or his duly authorized representative and the engineering department of the respective utility. All water mains, sanitary sewers and laterals, and storm sewers shall be installed as necessary to prevent the future cutting of the pavement of any street, sidewalk or other required pavement.

    (1) Streets and alleys. On all streets and alleys within the jurisdiction of these regulations, a suitable hard surfaced, permanent type of pavement shall be constructed in accordance with the county construction specifications adopted by the commissioner of the county.

    (2) Sidewalks. Sidewalks shall be placed on both sides of all streets in a commercial subdivision and may be required in residential subdivisions in the vicinity of schools and other community facilities. Sidewalks, when required, shall be a minimum of four feet wide in residential areas and seven feet wide in business areas, and shall be constructed according to county specifications.

    (3) Curbs and gutters. Standard approved type curbs and gutters must be placed on both sides of all new streets within the area of jurisdiction of these regulations in accordance with the specifications of the county.

    (4) Water system.

    a. Where a public water supply is within 300 feet of the subdivision, the subdivider shall connect with the same. The design and specifications of the distribution system shall meet the state water supply requirements. Water mains shall be extended the full length or width of the pavement.

    b. If a well is required for each lot, the location, construction and use of such a well shall also meet state department of human resources requirements. If a well is to serve more than one lot, a public water system shall be required. The design and specifications of such distribution system shall meet health department specifications, and shall be installed under inspection of the health department.

    (5) Fire plugs. Fire plugs shall be installed along each street at a maximum interval of 1,000 feet, or at the ends and center of each block. The water supply and pressure shall be sufficient to adequately serve the potential needs of the intended land use.

    (6) Sanitary sewers.

    a. Where a public sanitary sewer system is within 300 feet of the subdivision, the subdivider shall install a sanitary sewer system which meets the requirements of the state water quality control department and shall connect such system, at his expense, to the public sanitary sewer. Stub-outs shall be provided for each lot and shall extend from the sewer line to points outside the roadway.

    b. If a private system is installed, it shall be constructed in accordance with the requirements of a public system. If septic tanks are installed, special approval must be obtained from the health department. Lot size shall not be less than the minimum standard, and shall be of satisfactory size for the proper installation of a septic tank sewage system as indicated by percolation tests.

    (7) Storm sewers and drainage structures. Storm sewers and drainage structures shall be designed and installed as required in accordance with good engineering practice. In no case shall the size of pipe used for storm drainage be less than 15 inches in diameter. The subdivider shall provide either:

    a. Portland cement concrete or asphaltic concrete curb, the face of which shall not be less than six inches in height, with backfill sloping toward the curb and higher than the curb to ensure drainage of surface water into the storm drainage system; or

    b. Properly constructed drainage ditches, with the valley line of the ditch at least six feet from the edge of the roadway surface. Where possible, the slopes of the ditch should be in a ratio of at least three to one, but in no case shall they exceed a ratio of two to one. Where the grade of the roadway exceeds five percent, the planning commission may require the developer to rip rap the ditches.

    (8) Property markers. All lot corners shall be marked with iron pipe not less than three-fourths inch in diameter and 24 inches long, and driven so as to be flush with the finished grade.

    (9) Oversize improvements. The commissioner shall participate in the cost of oversize improvements within a subdivision, if, in his judgment, such oversized improvements are necessary to serve large areas of land not in the subdivision, and if the cost of such oversize improvements is an unreasonable burden on the subdivider.

    (10) Street signs. One street sign will be required for each intersection.

    (11) Placement of utilities. The developer is encouraged to place all utilities underground. The street right-of-way shall be graded at least six feet, measured from the back of the curb or edge of the pavement on both sides of the street, to provide space for the installation of utilities, to prevent the encroachment of driveways into the street surface, to provide walkways off the paved vehicular surface, and to provide space for the future installation of sidewalks; provided, however, the planning commission may waive this requirement in cases where the subdivider can demonstrate that the topography of the land being subdivided is such that compliance with this provision would be impractical.
