§ 34-479. Scope, administration, enforcement and entry authority

  • (a) Approval.

    (1) Any owner of land which lies within the area of jurisdiction of these regulations who wishes to divide or resubdivide such land into two or more lots, sites or divisions, for the purpose, whether immediate or future, of sale or building development, shall submit a plan of such proposed subdivision to the planning commission for approval, and shall obtain such approval prior to the filing of his subdivision plat for record.

    (2) In order to secure review and approval of a proposed subdivision by the planning commission, the prospective subdivider shall, prior to making any street improvement or installation of utilities, submit to the planning commission a preliminary plat as provided in section 34-481(c). The preliminary plat shall be prepared by a registered state land surveyor. After approval of said preliminary plat, the subdivider may proceed with construction and the preparation of the final plat and other documents required in connection therewith as specified in section 34-481(e).

    (3) No plat of a subdivision of land within the area of planning jurisdiction of the county shall be filed or recorded by the clerk of court without the prior approval of the planning commission as specified herein.

    (b) Administration. The planning commission is authorized and directed to administer and coordinate these regulations. Final approval of plats, permits and other data shall be the responsibility of the planning commission as prescribed by law.

    (c) Enforcement. If the planning director shall find that any provision of these regulations has been or is being violated, the planning director shall notify in writing the person responsible for such violation, indicating the nature of the violation and ordering the action necessary to correct it. The failure to give such notice shall not prevent the planning director from enforcing this article as herein provided.

    (d) Entry authority. The planning director shall have the right to enter upon any premises at any reasonable time for the purpose of making inspections on the premises necessary to carry out his duties in the enforcement of these regulations.
